Privacy and Communications
You acknowledge and accept that Splitteroo may from time to time send you communications concerning your account or the Service via email.
Accounts, Passwords, and Security
You must be a registered user to access the Service. You hold the responsibility for maintaining the security of your password and should never disclose it to any third party. You are solely liable and accountable for any activity that transpires under your username.
Acceptable Use and Behaviour
You hold sole responsibility for your behaviour and your data related to the Service. You accede to indemnify, defend, and hold harmless Splitteroo and its licensors, and their respective directors, officers, employees and agents from any and all loss, cost, liability, and expense resulting from or associated with your data, your use of the Service, or your violation of these terms.
You, your company, and/or your customers are only to utilise the Software and Service for personal or commercial use. Usage must not breach or contravene any third party rights and is required to be in accordance to all relevant laws, rules and regulations.
Breach of this agreement through any unapproved use of all Splitteroo services, which may also be in violation of certain federal and state laws, could submit the unapproved user and their representatives to civil and criminal punishment.
There will be no provision of refunds for unused service at any times from Splitteroo. The user is able to opt-in to, and set the level of, recurring billing. The subscription will automatically renew at the end of the subscription period, unless expressly cancelled by the user. Invoices will be delivered in PDF format if so requested by the user, but else will not be provided.
The user must issue cancellations through the Service. To ensure there is sufficient processing time all cancellations must be issued at least 72 hours prior to the end of the subscription period.
Chargeback / Refund Policy
Under no circumstances will Splitteroo provide cash refunds. Please get in touch with our support team immediately if you have any queries in regard to charges made against your account. Your account or credit card will be credited for the appropriate amount of any charges made in error. Splitteroo maintains the right to permanently ban any customer who fails to complete a payment that is proven to be correct. Any outstanding charges will be pursued. If we are unable to succeed in claiming unpaid fees then they will be reported to the appropriate credit reporting agencies.
No Warranties or Representations
You understand and agree that the Service is provided "as is" and Splitteroo, its affiliates, suppliers and licensors hereby disclaim all warranties of any kind, beyond the Refund, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement or bailment of your data on Splitteroo's servers. Splitteroo, nor its affiliates, suppliers and licensors make warranty or representation, other than the Refund, regarding the results that may be obtained from the use of the Service, the security of the Service, or that the Service will meet any user's requirements beyond the Refund. Use of the Service is at Your sole risk. You will be solely responsible for any damage to You resulting from the use of the Service. The entire risk arising out of use, security or performance of the Service remains with You. Without limiting the foregoing, the Service is not designed or licensed for use in hazardous environments requiring fail-safe controls, including without limitation operation of nuclear facilities, aircraft navigation/communication systems, air traffic control, and life support or weapons systems.
Splitteroo maintains the right to terminate the account of any user, without refund, found to be in breach of its Terms of Service through the receipt of abuse complaints.
You are responsible for complying with any and all appropriate anti-spam regulations. We encourage you to ensure that anyone who signs up to your form is aware they will be contacted, and for you to provide an unsubscribe link in all of the emails you send out.
Limitation of Liability
In no event will Splitteroo, or its suppliers or licensors, be liable with respect to any indirect, special, incidental, consequential or punitive damages (including but not limited to loss of use, loss of profits, or loss of data) whether in an action in contract, tort (including but not limited to negligence), equity or otherwise, arising out of or in any way connected with the use of or inability to use this site or the materials therein or resulting from unauthorised access to or alteration of data. Splitteroo shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
Splitteroo is not liable for failure to perform its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service, or any other cause which is beyond Splitteroo’s reasonable control.
Termination of Service
Splitteroo maintain the right to right to terminate your account at any time. You have the right to close your account, without penalty, at any time. In the event of account termination, or cancellation, all data associated with your account will be deleted and unrecoverable.
We may alter or terminate our services at anytime, for any reason, and without notice. We maintain the right to alter these Terms of Service at any time without notice. Please review these Terms of Service on occasion as they may change in the future. We may, but have no obligation to, remove accounts and content containing what we determine as unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable material. We will remove content that violates any party's intellectual property or these Terms of Service. An account terminated by Splitteroo will not be backed-up for any reason and will be immediately deleted from our servers.
Splitteroo claims no intellectual property rights over the material such as trademarks, service marks, graphics and logos you provide to the Service. You acknowledge that Splitteroo owns all right, title and interest in and to the Service, including without limitation all intellectual property rights, and such rights are protected by UK and international intellectual property laws. You agree that you will not copy, reproduce, alter, modify, or create derivative works from the Service. Other trademarks, service marks, graphics and logos used in connection with the Service may be the trademarks of other third parties. Your use of the Service grants you no right or license to reproduce or otherwise use any Splitteroo or third-party trademarks.
It is understood that in order to use the Services, a device such as an iPhone, iPad, Android Phone, Android tablet or PC/Laptop is required. A modern browser such as Internet Explorer 10, Firefox 20, Safari 5 or Google Chrome 30 is required where applicable. Additionally, a stable connection to the Internet is required for installation and data synchronisation. The Services may work in a limited manner on other web browsers (such as earlier versions of the previously mentioned browsers), but the Services were not designed for use on web browsers other than those recommended above.
Use of the Services
You will not violate or attempt to violate the security of our website or the Services. You will not hack into the website, Splitteroo’s computer systems or the computer systems of other users of the Services. Hacking means unauthorised access, malicious damage and/or interference and includes, without limitation, mail bombing, propagating viruses, worms or other types of malicious programs, deliberate attempts to overload a computer system, broadcast attacks or any other method designed to damage or interfere with the operation of a computer system or website.
Website and Services Availability
We try to ensure continuous availability of the website and all the Services provided but accept no responsibility for the consequences of interruptions or delays, however caused. Splitteroo will work within reason to ensure this amount of down-time is limited. We may, additionally, alter the design and specification of the website or Service at any time.
Splitteroo cannot guarantee that any file or program available for download and/or execution from or via the Services is free from viruses or other conditions which could damage or interfere with data, hardware or software with which it might be used. You assume all risk of use of all programs and files associated with the Services, and you release Splitteroo entirely of all responsibility for any consequences of its use.
